Snow Level Three Emergencies and What it Means for You

DAYTON -- This past snow storm on Wednesday, forced two local counties, Mercer and Darke, to issue a level three snow emergency.

That's the highest level and means all roads are closed to non-emergency personnel.

No one should be driving unless it is absolutely necessary.

But there is no state law that prevents your employer from making you report to work.

"I'm just going to have to get fired because I'm not trying to get out there in that bad weather and get my life taken, or anything like that," said Jerrie Jones, lives in Dayton.

The roads in Montgomery County weren't hazardous enough for a level three, but if it had been issued, the sheriff's office says you can be cited if you're driving for unnecessary reasons.

"For you just to want to go see your girlfriend that just may not be, going out to a bar that night would clearly not be necessary driving," said Major David Hale, Montgomery County Sheriff's Office.

If your employer says you must come in, and you're pulled over on your way, you can fight it.

"You show proof of that employment and proof that you were there that day, that ticket should be dismissed," said Major Hale.

The sheriff's office asks that you do not call into dispatch, because they are busy during storms with emergencies.
