Martial Arts Fighter Sentenced to 7 Years in Prison for Assualting Officers

DAYTON -- A judge sentenced Nikolaos Boscarino, 28, Thursday morning to seven years of prison for assaulting three Dayton police officers last year.

The mixed martial arts fighter was found guilty of felonious assault on an officer and resisting arrest after an officer responded to a complaint at Taggart's Pub and said he saw Boscarino urinating in the bushes.

Montgomery County Prosecutor Mat Heck Jr. said the felonious assault count included a repeat violent offender specification because Boscarino has a prior felony conviction for felonious assault in Warren County.

That officer  was let go by the Dayton Police Department because of his injuries. He and a tearful Boscarino spoke in front of the judge today.

"My 26-year military career, two tours in Iraq, has to come to an end.  I cannot stay til I'm 60 years old as I planned, or get my 25-year pension as I planned as a police officer. I have already been sentenced by Mr. Boscarino," said former officer Smith.

"I apologize for any inconveniences and for any injuries that occurred that night. That was not my intent. I did not know," Boscarino said.

Boscarino also is also ordered to five years of probation and to pay court costs.

“This defendant, who is a trained, professional fighter, has shown he has a complete lack of respect for the police or authority," Heck said after the sentencing. "His vicious, unwarranted attack on Officer Smith has left him unable to return to work because of his injuries. This defendant clearly deserved a lengthy prison sentence.”
