DAYTON -- As a family is trying to make funeral plans, Dayton police are still trying to figure out who killed a mother of four.
Police said Tuesday ballistics reports indicate the bullet that killed pregnant mother, Da'Lyne Foster, last week, does not match the gun belonging to their number one suspect in the case.
"Where do we go from here? We go back to the beginning. We go back to all our witnesses at the scene." Dayton Police Sgt. Richard Blommel said.
The baby, Christopher Foster is not even a week old. He is still in the NIC U at Miami Valley Hospital.
The baby's grandfather, David Foster calls him a 7 pound miracle.
"We are fortunate that the bullet didn't wound him at all. He suffered trauma from the impact but is now breathing on his own." Foster said.
The baby's mother Da'Lyne Foster was shot and killed last week in the Desoto Bass neighborhood.
Police said Foster was an innocent bystander who was walking around trying to induce labor when a fight broke out and bullets started flying. Foster died but doctors were able to save the baby.
David Foster said he already forgives the shooter. " If I spend too much time dwelling on the actual event, I won't be able to focus on what needs to be done for my grandchildren and for my family."
Police are asking for any witnesses to come forward to help them solve this case. "We are still hopeful for a positive outcome in this."
