MERCER CO.--The Mercer County Sheriff's Office announced results in an officer involved shooting investigation.
They say Officer Andy Regedanz was acting in self-defense when he shot and killed 39-year old Robert Hensley.
It happened last week when the officer says he came upon Hensley shirtless, wearing a cowboy hat, and more twirling a gun.
The sheriff says before the confrontation, Hensley was eating at a nearby Eagles Lodge and tried to leave without paying.
Minutes later, Hensley was walking down the street with the gun.
"Hensley then turned aggressively to his left Pointing the gun towards Officer Regadanz, then raised his gun and fired two shots from his 40 Caliber Firearm," said Mercer County Sheriff Jeff Grey.
Hensley's family says he had been struggling with mental illness.
The sheriff's office will now turn the investigation over to the prosecutor's office.
