One of Two Brothers Acquitted for Murder, Sentenced to 5 years

SPRINGFIELD -- Today, a Clark County judge handed down a 5 1/2-year sentence to one of two brothers acquitted on murder charges for the shooting death of Jamez Hall.

Anthony Hottenstein, who was charged additionally with improper use of a firearm and two counts of tampering with evidence, was sentenced to 18 months for the firearm charge and 36 months plus a year for the tampering with evidence. The sentence totaled to 5 1/2 years; however, Hottenstein will only have to serve three because he was given credit for time served.

A jury acquitted Anthony and his brother, Jordan, of two counts of murder for an incident that occurred on July 23, 2011.

The brothers admitted they were going with Hall to complete a drug deal. However, Jordan Hottenstein testified that while driving on Old Mill Road, Hall tried to rob him of those drugs, displaying a gun and demanding he hand over the marijuana. The two struggled, and Jordan Hottenstein said he yelled for help from his brother, who was armed in the back seat. Anthony said he made a quick decision to shoot.  His brother was accidentally shot and when the car crashed the gun misfired causing a fatal gunshot wound to Hall.

The brothers were found not guilty of murder because of the Castle Doctrine, which states you have a right to protect yourself in your home or vehicle as self defense.
