UPDATE: Robbery Suspects Brandish Toy Gun, Victim Fights Back With Real One

UPDATE: FAIRBORN--Police said one of the intruders who broke into a Fairborn home, and was shot by the person living inside, has died. 

19- year Ta'Vaun Fambrough  died at the hospital.  Anthony Barwick, 20, was shot in the leg.  
Deron McGuire Jr. 23, London Norman, 23, Barwick and Tavaughn Lewis, 20, were all taken into police custody and face charges of aggravated burglary, aggravated robbery and kidnapping.

Police say the 5 men broke into a home on Victoria Avenue, where two Wright State students live.
"They all admitted they went into the house with the intent to rob the resident."   Fairborn Police Sgt. Paul Hicks said.
   
Police said one of the robbers pulled a toy gun, but that's when one of the students grabbed a real gun and shot two of the intruders.
 
"If someone came into my house,  and I had a gun, I'd do the same thing." Neighbor Lisa Middleton said.
 
Police said  the students  are not facing any charges,  because they  acted in self defense, but  the case will be presented to the Grand Jury next week.

Middleton believes in the Ohio Castle Doctrine, a law that says a homeowner is  allowed to use  deadly force, to defend themselves and their family,   against an intruder

"You got  to protect  yourself . You've got to fire back."  She said.  

FAIRBORN -- The man shot in the chest Monday during an alleged attempted robbery has died, Police said.

Fairborn officers said five men broke into a home at 1006 Victoria Avenue about 5 p.m. Monday brandishing a toy gun. The homeowner, however, had a real gun and shot two of the intruders.

Dead is Ta'Vaun J. Fambraugh, 19, of Dayton. He had been shot in the chest. Anthony E. Barwick II, 20, of Dayton was shot in the leg.

London K. Norman, 23, of Dayton, Deron C. McGuire Jr., 23, of Dayton, Tavaughn L. Lewis, 19, of Dayton, and Barwick all face aggravated burglary, aggravated robbery and kidnapping charges.

They are scheduled to be arraigned in Fairborn Municipal Court.

Police said the men in the home are not being charged at this time.

Double Shooting in Fairborn

FAIRBORN -- Five men try to break into a Fairborn home, but the homeowner opens fire, hitting two of the suspects.

It happened off Victoria Avenue around 5:30 on Monday. Fairborn Police say it's unclear what led to the break-in or if the homeowners know the suspects.

Police Sgt. Paul Hicks says three of the suspects are in custody, the other two are at the hospital. One of the men was shot in the leg, the other shot in the abdomen.

Hicks says when police arrived on scene it was chaotic because three of the men tried running away. They took all three of them into custody while detectives are at the hospital with the other two suspects.

Police towed away one vehicle that was sitting outside the house, which could have been used by the suspects.

Neighbors in the area say this is only the latest example of a growing problem that is getting out of control.

"Petrified. Terrified. Really, really scared. I don't feel safe anymore," said Tamara Ferguson.

Neighbors tell us they don't feel safe because of robberies and shootings, but worse is the drugs coming in and out of the area.

Hicks says he isn't aware of this neighborhood having high drug problems but says there are pockets for it. He says he doesn't know if this break-in had anything to do with drugs.

Police say what happened Monday night is not common for this area or anywhere in Fairborn.

Police did say they are looking to see if this home has had problems in the past.



BREAKING: FAIRBORN -- Police on the scene of a double shooting.  Right now our news crew tells us it appears a group of five people barged into a home at Harvard and Parkwood, apparently to rob it. 

But the people inside fired at the intruders, reportedly hitting two of them, and police tell us the other three are in custody.  Police are still trying to sort out all the details and we will bring you the very latest tonight on FOX 45 News at 10 and ABC22 News at 11.
