DAYTON -- Shoveling can has its risks not only medically, but legally as well. Ohio is one of few states where you have no legal obligation to shovel.
Based on Ohio's natural accumulation rules, they say a person or property owner can't be held liable if someone is injured.
Matthew Bruder, personal injury attorney with Dyer, Garofalo, Mann & Schultz in Dayton says he will get frequent calls on what a persons rights are with shoveling.
"If you have a blizzard come through the law doesn't state that you have to go out there and immediately start shoveling to make it safe," said Bruder.
Bruder says shoveling can be considered the right thing to do though and helps keep the community safe.
He says if you do shovel the snow, make sure you do it right, because that's when you could find yourself in some legal fees by moving around the snow.
"Don't make the condition worse than it was when the snow was just falling," said Bruder.
Bruder says to use things like salt to help make sure your sidewalks are safe.
While there's no law in the state, there are many city ordinances like in Oakwood where you are required to remove snow.
