DAYTON -- The death penalty is now off the table for a Miamisburg man who pleaded guilty Monday in court to murdering Lisa Spinks.  Shaffer reached a plea agreement with prosecutors to avoid the death penalty.

Prosecutors said Jamie Shaffer strangled Lisa Spinks on September 24, 2011.  They said Shaffer and his friend, Joshua Sellers, then took turns stabbing the 20-year-old Spinks in the neck.  They put brush over her body and placed her on railroad tracks in Miamisburg. A train severed Lisa's body in half.

Prosecutors said Spinks was mentally retarded and Shaffer used Lisa for sex. Prosecutors said Lisa fell in love with Shaffer and wanted a relationship.  They said Shaffer became annoyed with Lisa's texts and calls, and he and Sellers decided to lure Lisa to a creek bed where they killed her.

With his plea deal, Shaffer will receive a sentence of life in prison without the possibility of parole, and will be required to testify against Sellers in a trial scheduled for August. Shaffer will officially be sentenced after Seller's trial.

Lisa Spinks' family was in the courtroom but declined to comment on camera. One family member, who didn't want to be identified, said "Neither one of them deserves to live for what they did to Lisa."
