DAYTON -- Montgomery County Prosecutor Mat Heck Jr. is seeking the death penalty for convicted murderer Dameon L. Wesley, who is suspected in the killing of a 13-year-old girl.
Wesley is accused of entering his ex-girlfriend Dawan Culpepper's home on February 24 and attempting to kidnap her, then fatally shooting her daughter, Briona Rodgers, and injuring Briona's cousin, 13-year-old Alonta Culpepper and shooting at Dawan as she tried to escape.
Heck said Wesley has been indicted for:
⢠4 counts of Aggravated Murder
⢠4 counts of Attempted Aggravated Murder
⢠1 count of Aggravated Burglary
⢠1 count of Aggravated Robbery
⢠1 count of Kidnapping
⢠1 count of Menacing by Stalking
⢠1 count of Having Weapons While Under Disability.
All but one of the counts include three-year Firearm Specifications. The counts of Aggravated Murder carry an additional six Aggravated Circumstance Specifications, making it a death penalty case, Heck said.
Heck said Wesley was on parole, and had been released from prison September 4, 2012.
Heck was critical of the state's decision to grant Wesley's parole.
"It's interesting, because in 2004, the parole board found that this defendant's 'institutional conduct has been poor' and they denied parole. In 2008, they found that 'this defendant is a more serious risk and not suitable for release,' and they denied parole. In 2010, they determined that release of this defendant would 'create undue risk to public safety and would not be in the best interest of justice,' and denied parole," Heck said during a press conference today.
Heck said the death penalty should be reserved for the most heinous crimes and offenses.
"This defendant has previously been convicted of murder and was on parole for only five months at the time he committed these crimes,â Heck said.
