Fired Miami Township Deputy Police Chief Files Appeal

MIAMI TWP.--The attorney for Miami Township's Deputy Police Chief, John Dipietro has filed an appeal in the case.

Deputy Chief, John DiPietro was fired February 13th in an unanimous decision by the Board of Trustees.

The Board found him guilty of several violations stemming from an incident where he hosed off a 17-year girl after she was pepper sprayed.  The teen was accused of shoplifting. 

According to reports, there were no other officers present when the suspect took off her clothes.

The Board of Trusees believed Dipietro violated the code of conduct.

Late Tuesday, his attorney filed the administrative appeal with the Montgomery County Common Pleas Court. Among other things, the appeal claims that there was no evidence that Dipietro violated any departmental rules.

The appeal also states that Dipietro should have received counseling and been given additional training instead of being fired.

He had been on admistrative leave since October. There were no criminal charges stemming from the incident.

Dipietro served on the Miami Township Police Department for almost 24 years.
