UPDATE: Kettering Police Make Arrest in January Parking Lot Assault

UPDATE--A Wednesday afternoon news conference held by Kettering Police have providing more information about the man accused of sexually assaulting a woman in a Kettering Big Lots.

Wade Adams is charged with two counts of kidnapping, three counts of gross sexual imposition, and one count of grand theft and tampering with evidence.

Police arrested Adams Tuesday afternoon at an apartment building at 1216 E. Dorothy Lane, Kettering.

Officers were serving him a warrant because he violated probation, but tests revealed that his DNA matched the DNA collected during a sexual assault in at a Big Lots parking lot back in January.

On January 26th, police say Adams attacked the woman inside of her car, a struggled ensued and the attacker sexually assaulted her. The victim was able to escape, but was not able to find Adams. Fortunately, DNA evidence collected on the scene led police to Adams.

"He has been arrested before and on at least one of those arrests a DNA sample was collected," said Dan Gangwer, Lieutenant with the Kettering Police Department.  "We are up to this point very satisfied the system of checks and balances that are placed especially in this case in regards to DNA not only exonerated one but helped us make an arrest on another." 11:51:27

Adams arrest makes residents of Kettering feel good knowing that a potential criminal off the streets.

"The scientific breakthroughs that they've done for crime preventions is absolutely wonderful there's a spirit of evil that's going on that we just can't seem to put our arms around," said Goodloe Gillipsie, who shops in Kettering often. "We just have to be more careful and mindful we just can't assume that no one will bother us when we are out and about shopping And be mindful of who's around you, take a look around before you walk out the store 11:59:56

Adams is currently being held in Montgomery County Jail on a $500,000 bond.

KETTERING -- Police are holding a news conference right now and ABC 22/FOX 45 has learned that they will announce an arrest in a January 26 kidnapping and sexual assault case

Police on Tuesday arrested 41-year-old Wade Adams. He is being charged with two counts of kidnapping and a count each of grand theft, gross sexual imposition and tampering with evidence after police arrested him Tuesday afternoon at an apartment building at 1216 E. Dorothy Lane, Kettering.

A woman reported being sexually assaulted and kidnapped January 26 outside the Big Lots store on Wilmington Pike.

Just days after that 26 incident, Kettering police arrested Joseph Budz, 49, but charges were dropped when DNA evidence didn't match what was taken from the victim.

UPDATE: Suspect in Sexual Assault Cleared When DNA Evidence Doesn't Match

KETTERING -- Police said the man who attacked a woman last week at a shopping plaza, remains at large.

DNA has cleared charges against a Dayton man accused of kidnapping and sexual assault.

Kettering Officer Ron Roberts said DNA testing proved that Joseph M. Budz, 49, is no longer their suspect in the abduction of a woman in the Big Lots parking lot, last week on Wilmington Pike.

"The DNA taken from the scene did not match his DNA," he said.

Budz was arrested last week after being stopped for jaywalking. A Kettering officer noticed Budz's resemblance to the police artist's sketch of the suspect from the assault.

After police took Budz into custody, the victim of the assault picked Budz out of a line up. He was booked into jail on charges of kidnapping, gross sexual imposition and felony theft.
Those charges have been dropped.

Budz remains in jail on an outstanding warrant unrelated to the abduction and assault case.

The DNA collected at the scene will now go into a nationwide data base, in hopes to arrest the correct suspect.

"We want the right man behind bars," Roberts said.

KETTERING -- The man suspected in a January 26 sexual assault who was picked up while jaywalking has been cleared of those charges after investigators say DNA evidence wasn't a match.

The DNA sample they have of the suspect now will be submitted to the state for possible matches.

Joseph M. Budz, 49, of Dayton was arrested by Kettering Police about midnight Tuesday, after officers said he was jaywalking on East Dorothy Lane near Bobbie Place.

The arresting officer reportedly noticed Budz resembled the suspect sketch that Kettering Police had released.

He was jailed on kidnapping, gross sexual imposition and felony theft charges.

Police Arrest Man They Say Abducted, Sexually Assaulted Woman

KETTERING--Police have arrested the man they say sexually assaulted and abducted a woman over the weekend.

Joseph M. Budz, 49, of Dayton was arrested by Kettering Police about 12 a.m. Tuesday, after officers caught him jaywalking on East Dorothy Lane near Bobbie Place, according to a release from the Kettering Police Department.

The arresting officer reportedly noticed Budz resembled the suspect sketch that Kettering Police released on Monday.

Police arrested Budz on a previous warrant for failing to comply from a previous disorderly conduct arrest.

He was taken to the Kettering Jail where he was booked for kidnapping, gross sexual imposition and felony theft. Formal charges are pending from the Montgomery County Prosecutor's Office.

KETTERING -- Police need your help to identify and locate the man they said allegedly abducted and sexually assaulted a woman over the weekend.

The alleged incident happened about 7:30 p.m. Saturday in the parking lot of the Big Lots located at 2800 Wilmington Pike.

A woman was inside her car when an unknown man entered the vehicle and allegedly sexually assaulted her, police said.

After the alleged sexual assault, the suspect then allegedly abducted the victim, driving her vehicle to an apartment complex on Bobbie Place. That’s where police said the suspect abandoned the vehicle and took off on foot towards East Dorothy Lane.

Police are looking for a white male approximately between 30 and 40 years of age, standing about 5’8” tall and weighing an estimated 150 pounds, with a slight tan. The suspect reportedly has a scruffy beard and was last seen wearing blue jeans, a dark jacket and a burgundy and blue stocking cap.

Police issued this drawing as a description of the suspect and the style stocking cap he was wearing at the time of the alleged incident.
